Food Classification & Labeling Compliance


We help our client to classify & comply their Food Products in Malaysia.


Food as defined under the Food Act 1983 and Food Regulations 1985 includes every article manufactured, sold or represented for use as food or drink for human consumption or which enters into or is used in the composition, preparation, preservation of any food or drink and includes confectionery, chewing substances and any ingredient of such food, drink, confectionery or chewing substances. This includes food for special dietary use for persons with a specific disease, disorder or medical condition and food which contain quantities of added nutrients allowable under the Food Act and Regulations.

For Food product, there is no Pre-Market Registration required but the label of Food product must comply with the requirement under the Food Act and Regulations.

However, for certain products with no direct inference whether the food is normal food or health supplement, you are required to submit the product to our MOH for obtaining the official Classification Conformation Letter before importation failing which the product will be detained in the custom. (Note: For health supplement, your company needs to register your product with our Ministry of Health prior to the importation.)

The process for Food Classification & Labeling Compliance as follow:-
1. Pre-Classification Ingredient Assessment Before the food product can be classified by our MOH, each and every ingredient must be assessed to make sure the active and/or non-active ingredients are permissible to be used and do not over the limit determined by our MOH.

2. Food Classification
After ingredient assessment & formulation advice, we shall proceed to documentation advice. Upon completion, we shall proceed to the classification submission. MOH will take about 4-5 weeks to assess the formulation and documents submitted to them. If every requirement is complied and there is no further query / information needed, then, classification approval will be issued.

3. Labeling Compliance
After classification, we shall proceed to labelling compliance advice. Upon completion, we shall proceed to the submission. MOH will take about 5-6 weeks to assess the labeling documents submitted to them. If every requirement is complied and there is no further query / information needed, then, the approval letter will be issued.
